1. Eligibility and Use

This site is for personal, non-commercial use. You may not copy, resell, or exploit any portion of the site, products, or content without prior written consent from HAS/BEEN.

2. Products and Pricing

Products, prices, and availability may change without notice. We make reasonable efforts to display product details and colors accurately, but displays and devices can vary.

3. Payment Methods

All prices are in United States Dollars (USD). Accepted payment methods are those shown at checkout (e.g., Visa, Mastercard, American Express, PayPal, Shop Pay, Apple Pay, Google Pay). You authorize us to charge your selected method for the total order amount, including applicable taxes, duties, and shipping.

4. Orders and Processing

Orders are offers to purchase and may be accepted or rejected at our discretion, including for suspected fraud or inventory issues. Provide accurate billing, shipping, and contact information; we are not responsible for delays or failed delivery arising from incorrect details. Once an order is submitted, changes may not be possible if processing has begun.

5. Shipping, Duties, and Taxes

Orders are fulfilled and shipped from Utah, USA. Processing typically takes 3–5 business days, excluding weekends and US holidays. Delivery windows shown at checkout are estimates, not guarantees. Title and risk of loss transfer to you when the order is handed to the carrier.

Prices shown at checkout generally exclude shipping, customs duties, import taxes, and brokerage fees for destinations outside the United States. The recipient is responsible for all such charges. Customs rules vary by country; check with your local authority before ordering.

6. All Sales Final; Defects Policy

All sales are final unless the product is defective or incorrect on arrival.
If you receive a defective or incorrect item, email support@hasbeenofficial.com within 5 business days of delivery. Include your order number, a description of the issue, and clear photos of the item and packaging. Items must be unworn and in original condition with tags attached. Upon inspection and approval, we will provide an exchange for the same item or, if unavailable, store credit. Return shipping instructions will be provided with your Return Authorization. Unauthorized returns may be refused.

7. Cancellations and Processing Fees

Orders cannot be cancelled after processing begins. If an order is cancelled before processing (at our discretion), any non-refundable payment processor fees may be deducted from the refund. This reflects charges imposed by third-party processors and is not a penalty.

8. Limited Releases and Markdown Policy

Many releases are limited. Limited releases and special drops are not eligible for return, exchange, or price adjustments. HAS/BEEN does not guarantee future restocks or markdowns.

9. Sizing and Custom Requests

Refer to the Size Guide on each product page. For extended sizing or custom requests, contactsupport@hasbeenofficial.com before purchasing; custom orders may carry additional lead time and fees and are final sale.

10. Intellectual Property

All content on this site, including trademarks, logos, graphics, product designs, photography, video, and copy, is owned by or licensed to HAS/BEEN and protected by law. No rights are granted by implication or otherwise. Any unauthorized use is prohibited.

11. Accuracy, Errors, and Omissions

Information on this site may contain typographical errors, inaccuracies, or omissions, including in pricing, availability, and descriptions. We may correct any errors and update information at any time without prior notice, including after an order is submitted.

12. Third-Party Services

Payment processing and shipping are provided in part by third parties. Your use of those services may be subject to additional terms and privacy practices not controlled by HAS/BEEN.

13. Disclaimer of Warranties

Except as expressly stated, products and services are provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by law.

14. Limitation of Liability

To the fullest extent permitted by law, HAS/BEEN and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or use, arising out of or related to your use of the site, products, or services. In no event will our aggregate liability exceed the total amount you paid for the specific product(s) giving rise to the claim.

15. Indemnification

You agree to indemnify and hold harmless HAS/BEEN from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your misuse of the site, violation of these Terms, or infringement of any third-party rights.

16. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Venue and jurisdiction will lie exclusively in the state or federal courts located in San Diego County, California, unless we agree otherwise. You and HAS/BEEN waive any right to a jury trial to the fullest extent permitted by law.

17. Changes to These Terms

We may update these Terms at any time by posting a revised version on this page with a new Effective Date. Your continued use of the site after changes are posted constitutes acceptance of the revised Terms.
